CashNGoAffiliate.com works with ISPs and anonymous proxy firms in order to detect abuse and fraud and assists law enforcement agencies in the future prevention thereof. Anti-Spam Policy Spam is defined as the sending out of UNSOLICITED BULK EMAIL. This action is not permitted in any way, shape, or form in connection with the use of your CashNGoAffiliate.com website, PERIOD!! Deemed violations of this policy WILL result in the immediate termination of your CashNGoAffiliate.com account. Transfer of Account Your membership with CashNGoAffiliate.com is deemed as a service being provided to you and/or your business. It may not be considered a business entity to which you have ownership and therefore your position may not be bought or sold without our written consent. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Password Sharing Access to the CashNGoAffiliate.com members area is through a combination of a username and a password (ID). Members may not under any circumstances release their ID to any other person, and are required to keep his or her ID strictly confidential. The exception to this condition is the sharing of this information with a legitimate business partner. A legitimate business partner is deemed to be an individual who shares legal ownership in legally licensed business or corporation with you. This definition DOES NOT apply to a joint venture between two (2) or more individuals or between two (2) or more separate business entities. Password sharing outside the exception mentioned above will result in the immediate termination of your CashNGoAffiliate.com membership. Limitation of Liability USER DISCRETION IS ADVISED: IM Business Manager Resource Center, and/or its associates will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or your membership or the CashNGoAffiliate.com website, even if we have been advised of the possibility of such damages. No Guarantee CashNGoAffiliate.com makes no promises or guarantees on how the CashNGoAffiliate.com members site may affect your website visitor traffic or your financial success. Additionally, although it is our sincere desire to have all areas of the CashNGoAffiliate.com site fully functional and available for use at all times, there may, from time to time, be a disruption in service due to server issues and/or script failure. Once we have learn of particular problem we will attempt to correct the issue in a reasonable and timely manner. If any modification is unacceptable to you, you have the right to terminate this agreement. Period of Agreement The term of this Agreement will begin upon our acceptance of your online application/order and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party notice of termination either in writing, by email or by telephone or fax. You are only eligible to earn referral fees on sales occurring during the term. Miscellaneous Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. Notices by CashNGoAffiliate.com to CashNGoAffiliate.com members may be given by means of electronic messages through the CashNGoAffiliate.com member's area, by a general posting on the CashNGoAffiliate.com site, or by conventional mail. Notices by CashNGoAffiliate.com members may be given by electronic messages, conventional mail, telephone or fax unless otherwise specified in the Agreement. All questions, complaints, or notices regarding the CashNGoAffiliate.com members site to CashNGoAffiliate.com must be directed here. YOUR ACKNOWLEDGEMENT BY CHECKING ON THE "I AGREE" CHECK BOX IN YOUR APPLICATION YOU ACKNOWLEDGE THAT AGREE TO ALL OF THE TERMS AND CONDITIONS CONTAINED HEREIN. ADDITIONALLY, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT. |
